Housing is a surprisingly complex topic. When we talk about housing and housing insecurity, we can be referring to different pieces of the housing landscape. For instance, an organization providing affordable housing is often distinct from an organization providing emergency shelter. But to connect to the proper resource, we need to first have a vocabulary for the different categories that exist within the field of housing advocacy and housing access. Generally, housing conversations fall into three categories:

  • Emergency Housing & Homelessness Assistance – Shelters, Community Action, General Assistance program
  • Affordable Housing– Affordable rental housing, housing subsidies, and first-time homeownership programs. 
  • Advocacy, Development and Finance– Regional, State, and Federal avenues for advocacy, organizations providing housing advocacy, housing financiers and housing developers

Equity, inclusion & housing choice:

When we talk about housing access, we need to approach each resource from the lens of Equity, Inclusion, and Housing Choice. In Chapter 1 we highlighted why housing choice is important, but recognized many are not able to access their right to equal opportunity and choice in securing housing. In particular, we need to recognize that BIPOC renters are often excluded from equal opportunity to housing due to historically racist housing policies, and present day biases which continue in our housing practices.

Emergency Housing & Homelessness Assistance – Shelters, Community Action, General Assistance program

Often when we hear about housing limitations, we hear about it from the lens of homelessness. For people currently without housing or who have received an unexpected termination of tenancy notice, we have emergency housing programs. A wide variety of organizations including state government, local government and non-profit organizations assist persons at risk of homelessness or currently experiencing homelessness. The type of assistance varies based on your unique circumstances. Assistance can include emergency sheltering for individuals or families, food, job training, and assistance specifically for homeless veterans or folks fleeing domestic violence.

In the world of housing emergencies, the services can be split into two general categories based on the following question:

Do you need an immediate place to stay tonight?

or

Are you looking to get or keep housing?

A note on language: 

Generally, to receive what we call “emergency housing” services, we say a person has to be “homeless.” HUD (the United States Department of Housing & Urban Development ) has a very specific definition of homelessness, divided into four categories.

  • Category 1, Literally Homeless: an individual who lacks a fixed, regular and adequate nighttime residence
  • Category 2, Imminent Risk of Homelessness: an individual or family who will imminently lose their primary nighttime residence. “Imminently” means very soon, in this case specifically within 14 days of applying for homeless assistance.
  • Category 3, Homeless under other Federal Statutes: This is a complicated category, which includes unaccompanied youth who are younger than 25, or families with children who do not otherwise qualify as homeless under this definition but who:
    • have not had a lease, ownership interest, or occupancy agreement in permanent housing during the 60 days before they submit an application for homelessness assistance. For instance, a verbal agreement within that 60 day window might make people in this category ineligible to receive homelessness assistance.
    • Have experienced “persistent housing instability.” Persistent housing instability is further defined as two or more moves within the 60 days leading up to the application for assistance.
    • And lastly, the person(s) must also be expected to continue in this unstable state for an extended period of time due to special needs or barriers to qualify for this category
  • Category 4, Fleeing/ Attempting to Flee Domestic Violence: Any person or family who is fleeing or trying to flee a domestic violence situation, without an alternative place to live or the resources to get alternative housing fits into this category.

We learned in Chapter 1 , while covering the Point In Time count, that folks without housing are more than the people in shelters, cars, and campers. There can be overcrowding situations, couch surfing, and other circumstances that may change suddenly for anyone. Living in a precarious or unsafe housing situation, for some, may be easier than identifying with the term “homeless,” and facing the stigma often associated with houselessness. For those of us who are advocates, we are charged with the responsibility to shed light on the shortage and inequities in our housing landscape, which bar people from their basic right to housing for no fault of their own. It is important to remember that houselessness and housing precarity can come up in a lot of different ways, and it can change from one day to the next.

Shelters

Shelters are temporary housing options for people with immediate housing needs. This list covers shelters across the state. Shelters can sometimes be specific in who they serve- for instance, some shelters are for children and family, and some provide housing for people fleeing domestic violence. Shelter availability can fill up quickly, so it’s important to call 211 if seeking shelter.

General Assistance/ Emergency Assistance Program

You might wonder how 11 shelters can house the 2,780 Vermonters who experienced “literal homelessness” during the Point in Time Count last year (2022). Short answer- they can’t! That is why we also have what’s called the “General Assistance Program” and the “Emergency Assistance Program.” Administered by the Economic Services Division (ESD) within the Department for Children and Families (DCF), the General Assistance Program (GA) is an emergency financial assistance program providing the basic necessities of life when those needs cannot be met by any other assistance program within DCF. These state programs essentially allow people without housing, and who meet specific, state-designated requirements, to access emergency, temporary housing through a motel-voucher program for participating motels.

The eligibility for these programs change with each legislative session, and generally fall into three categories: Vulnerable Population, Catastrophic, and Adverse Weather. But even these programs can fill up. You can check the Housing Capacity by region for the GA program on DCF’s Website here. On the day I wrote this blog- a weekday in February of 2023 – the capacity for most GA Emergency Housing is “none” with some regions listed as “extremely limited.” Folks without cars may have to travel long hours on buses to find a place to sleep that night. Some people’s only option is to find the closest thing to shelter that they can- beneath the eaves of a building, in their car, an enclosed ATM machine, a public bathroom.

Community Action Agencies

Community Action Agencies and other Homelessness Prevention Centers provide the much needed support for people at risk of houselessness or exiting homelessness. Vermont has 5 Community Action Agencies (including CVOEO, where we are located):

Community Action Agencies are a very important piece of Vermont’s resources for financial stability. Established through the Economic Opportunity Act of 1964 and financed by state and private funding, these agencies provide programs and serves to Vermonters with low or moderate income. Programs and services include financial stability (including classes on credit and budgeting and coaching of micro businesses), Head Start and services for parents, community advocacy programs (such as the Housing Advocacy Program and Voices against Violence), resources for food access and food security, energy assistance programs (such as crisis fuel assistance and weatherization services), and housing assistance.

On Housing Assistance & Community Action Agencies:

Community Action teams providing housing assistance – a critical part of Vermont’s housing support services- work with individuals and families who are homeless or at-risk of homelessness.  While housing insecurity can be complex, nuanced and deeply personal, to receive their services you must meet the federal definition of homelessness or at risk of homelessness. As we covered above, that definition is very specific and not very flexible. To access Community Action resources, you must be:

  • Literally Homeless
  • Imminent Risk of Homelessness
  • Homeless under other Federal statutes
  • Fleeing/ Attempting to Flee Domestic Violence

Importantly, Community Action Agencies do not provide emergency housing assistance. That is why we emphasize that people seeking emergency shelter contact your local Economic Services Department (ESD).  (The number for the Statewide ESD call center is 1-800-479-6151) or call 2-1-1 after hours or on the weekends

Housing navigation is available to help secure affordable housing and, if eligible, to provide assistance for security deposits, rental assistance or rental arrearage.

Continuum of Care

What is a Continuum of Care?
A “CoC” consists of a partnership of service & resource providers, housing developers, state agencies, and others in the homelessness or low-income service system in a geographic region. This is a network of organizations, which work together to:

  • CoCs monitor and address housing and service gaps through proactive solutions;
  • Conduct an annual homeless count;
  • Coordinate efforts with the statewide planning body.

The Continuum of Care Program is a HUD program “designed to promote community wide commitment to the goal of ending homelessness.” HUD recognizes two Vermont CoCs, which provide  both planning initiatives to end homelessness, as well as funding to organizations working to end homeless.

Vermont Balance of State CoC: The Vermont Balance of State COC covers all of Vermont except Chittenden County. The two “applicants” to receive the CoC funds from HUD are the Vermont State Housing Authority and the Office of Economic Opportunity. The Vermont Coalition to End Homelessness (an organization we will talk about in greater detail in Chapter Four, as a part of our coverage on housing advocacy) is the “governing body” of the Balance of State CoC.

  • Underneath the umbrella of the Balance of State CoC are eleven local Continuum of Cares which serve the regions across Vermont, besides Chittenden County. These local CoCs do not provide funding. To learn more about CoC’s, you can visit the Vermont Coalition to End Homelessness’ website here

Chittenden County Homeless Alliance: Chittenden County has its own CoC, which is recognized by HUD, does provide funding, but is not overseen by the Balance of State CoC.  Chittenden County is served by the Chittenden County Homeless Alliance, also know as CCHA, “the Alliance,” and the Chittenden CoC.

  • Chittenden County has the greatest housing shortage, the lowest vacancy rate, and the easiest access to resources through its higher density city-centers as well as its more robust bus line. For some in our state, this may be perceived as a sign that Chittenden County has a greater homelessness problem than the rest of the state. The reality is that many people receiving homelessness assistance in Chittenden County come from rural communities. This unequal distribution of resources is part of the reason our lowest income community members, our most vulnerable community members, and those of our neighbors who have been denied the right to homeownership and wealth accumulation are not able to have choice in where they live. In Chapter 4, we will take a deeper dive in why our housing resources are not equally distributed, and what we can do to address it.

Emergency housing is a critical part of our state’s network of housing resources, but addressing our housing needs requires more than just emergency housing programs.

Vermont Legal Aid & the Vermont Landlord Association Launch Tenant- Landlord Mediation

Vermont Legal Aid and the Vermont Landlord Association have launched a Tenant-Landlord Mediation Program. The program is free and open to any landlord and tenant who has disputes that need to be mediated

The Tenant-Landlord Mediation Program’s purpose during the eviction moratorium is to help landlords and tenants find solutions to the problems between them. During “mediation,” a neutral third person helps people discuss and try to resolve disputes. The Landlord-Tenant Mediation Program in Context:

Since the pandemic, a few key resources have emerged to offer tenants additional protections so that they can shelter-in-place during this time when having housing is so critical. The state of Vermont has a ban on evictions through three separate laws or rules: the federal CARES Act, the Vermont Judiciary’s emergency rules, and a state law called S.333 which pauses all evictions since last May until the governor ends the state of emergency. Vermont Legal Aid keeps updates around the eviction moratorium here

While the eviction moratorium does not absolve tenants from paying rent, tenants who haven’t been able to pay all or some of their rent are eligible for relief through the Rental Stabilization Program. The Rental Stabilization program is a $25 million program which gives renters and landlords a way to apply for coronavirus relief funds to cover unpaid rent, even if it was from before March of 2020.  Participation in the Rental Stabilization requires communication between tenants and landlords, as both need to apply. We wrote more about the Rental Stabilization Program here.

Sometimes issues other than money get in the way of landlord/tenant relationships- that’s where the mediation program comes in. The Tenant-Landlord Mediation Program is a way to help address these more complicated problems. Wendy Morgan, an attorney at Vermont Legal Aid, tells us the program builds on the larger goal initiated by the Rental Housing Stabilization Program to keep people housed during the pandemic. “This is a way of addressing the tensions between some landlords and tenants- very few have had this issue, almost 4,000 pairs have applied and received funds,” Wendy told the Fair Housing Project.

Angela Zaikowski, Director Vermont Landlords Association, adds, “In an attempt to be mindful that there are situations that are not working for landlords and tenants, this mediation program hopes to provide an outlet for some of the disputes between landlords and tenants.  It is a path for the parties to take advantage of given that the normal process through the courts is not available right now.”

Applicants for the Landlord-Tenant Mediation Program do not have to be a partof the Rental Stabilization program, but both the landlord and tenant have to apply.

1.     Help with past-due rent Apply by Dec. 11

For help with past-due rent, Vermonters should apply for the Rental Housing Stabilization Program through the Vermont State Housing Authority (VSHA.org). Tenants and landlords apply for this program at the same time. There are no income limits. VSHA pays landlords directly to bring the tenant’s rent account current. You can get help now, and apply again if you still need help later.

2.     Moving to a new home  Apply by Dec. 11

Some people need to move because of life safety problems with their rental unit, the rent is too expensive, they have trouble with the landlord or other tenants, or the unit is too big or too small. If you need to move and have found a new landlord, apply together for the Money to Move program at vsha.org. The program can cover the money needed to move in, such as first and last month’s rent and security deposit. It also may cover rent payments through the end of this year.

3.     Free mediation program for landlord-tenant disputes during the moratoriumApply ASAP

Sometimes issues other than money get in the way of settlement and dismissal of eviction cases. Mediators are available to help landlords and tenants solve those issues and maintain tenancies. File joint application found at www.vtlandlord.com.

4. Emergency housing for people who do not have a home

The Department of Children and Family’s (DCF) Economic Services Division is extending housing supports for homeless households. For more information or to apply, contact the Benefits Service Center at 1-800-479-6151. If you stay in a shelter or motel, you need to participate in “coordinated entry.” You will be assigned a housing case manager who will help you access subsidies and programs to help you get permanent housing. To learn more about coordinated entry, call 2-1-1. If you worked with your case manager to apply for a subsidy or other program and your application was denied, call Vermont Legal Aid at 1-800-889-2047.

5.     Past-Due Utility Bills Apply ASAP

The Department of Public Service (DPS) can help pay past-due utility bills. The bills can be for electric, natural gas, landline telephone service or regulated private water bills (not municipal water). Homes and small businesses are eligible. There are no income limits, and you don’t have to have a disconnect notice. However, unless the rules are changed (please check), your difficulty paying the bill must be linked to COVID and the funding only covers arrearages after March 1, 2020. If you need help to fill out an application online, contact your local community action agency. Learn more on the Department of Public Service website under “COVID-19 Arrearage Assistance Program.”

6. Mortgage Assistance Program (and maybe Property Tax Assistance) Apply by Nov. 6

This program can pay up to six past-due mortgage payments on your home. It is available to all Vermonters who:

-are at least 1 month past due on mortgage payments

-have a COVID-related hardship, and

-meet the income requirements.

Even people who have mortgages in forbearance are eligible. Apply if you have a mortgage and are behind on property taxes. Vermont Housing Finance Agency is taking applications for the VT COVID Emergency Mortgage Assistance Program at VHFA.org. (You do not need to have a VHFA mortgage to be eligible.)

Eberle’s voice offers a fresh perspective on homelessness, not just from his background working with homeless individuals through his work at AHS, nor his many roles working with at risk youth at Another Way and otherwise in Vermont communities. But Eberle speaks from his own personal perspective, having been without housing himself.

Eberle shares vivid vignettes of homeless individuals who he has worked with or encountered throughout his life, illustrating just how varied that experience might be and look like. Be it the young adult experiencing homelessness for the first time after exhausting their family resources, the full-time, minimum wage worker who sleeps in their car after full day shifts, or the chronically homeless individual who remains upbeat despite lack of access to permanent housing, Eberle shares their narratives with a frank honesty that personalizes a systemic issue across our state and country.


Community Pulse is a creative and thoughtful way to engage the every-day-listener around the housing crisis in our state, a much needed new take on an old, persistent issue. We are in an unprecedented moment, still deep into a health crisis that has magnified existing economic and health disparities and has destabilized our country, state, and communities. Meanwhile, there is a tremendous energy for civic engagement and people are finding ways to make positive change at the local level and to support their neighbors.

It’s clear that safe, affordable homes are the foundation for opportunity and there is a strong correlation between health disparities and housing opportunity, especially for people of color and others in protected classes. Thousands of Vermonters were already in a precarious housing situation before covid – and tens of thousands more struggle to find affordable, and accessible homes.

A local housing committee can be an effective tool for addressing housing needs and promoting equal housing opportunity in towns and cities of all sizes. These committees can take the form of a municipally-supported committee, subcommittee of the planning commission, resident advocacy group, housing discussion meet-up, or any other group that seeks to support or change the quality, quantity, affordability, and/or inclusiveness of housing in a community.

This interactive webinar provides an overview of the role and function of Housing Committees with examples from municipalities around the state. We will discuss how a local Housing Committee can help your community address housing needs and challenges, engage residents, and help advance community planning priorities.

ROUND UP: Rental Stabilization Program

COVID-19 takes its greatest toll on the most vulnerable, oppressed, and marginalized in our communities.

The Vermont Housing Finance Agency examines racial inequity in VT homeownership as it relates to the states history of housing segregation & communities of color current vulnerabilities during the pandemic.

The National Fair Housing Alliance reported an uptick in housing discrimination complaints throughout the pandemic, some of our hardest hit communities nationally included homeless populations and low-income, essential workers, the pandemic disproportionately affected people of color and housing advocates argue the nation’s history of housing segregation is at fault. The pandemic has forced our housing communities to adapt in many ways.

The good news is that here in Vermont we have pulled out some remarkable solutions. This spring housing advocates effectively temporarily ended homelessness in our state. Our own Champlain Housing Trust garnered national attention with this Shelterforce article for its ingenuity with the pre-exisiting Harbor Place, a former motel purchased by Champlain Housing Trust to provide services and transitional housing to homeless individuals. In Woodstock, a mutual aid group, the Woodstock Area Relief Fund, raised $320,000- nearly half of which went to rent and mortgage relief. Vermont passed an eviction moratorium,  a critical but complicated law which gave renters much needed relief during a time when unemployment was skyrocketing and many did not know when they would return to the workforce. In April we hosted a Fair Housing Friday about  renters’ rights during COVID-19 highlighting the eviction moratorium, which has been extended to Sept. 30. New reports show that Vermont has the 2nd lowest rate of pandemic-related housing insecurity. And this month the Rental Housing Stabilization Program started receiving applications.

The Rental Stabilization funds landlords on behalf on tenants who are in need of help paying past due rent. The program is intended to prevent folks from being evicted so that people can safely shelter in place during the pandemic. For this reason, people can apply even if their rental arrearage is not strictly related to the pandemic and *may* be able to use the program for back rent from before the pandemic. Both the tenant and the landlord have to apply. The program has $25 million and applications are first come, first serve. Applicants have to be income-eligible and their rent has to meet the affordability requirements set by Vermont Housing Finance Agency,  about $1,464 for a two-bedroom apartment in the Burlington and South Burlington area, and $1,199 for a two-bedroom in Central Vermont. Two weeks into the program, already an estimated 1,400 households applied for rental assistance.

Some of the questions asked during the webinar:

Q: If I have two tenants behind on rent applying for Rental Rehabilitation program and I only want to keep one of the tenants as a renter, can I apply for one renter and not the other?

A: That sounds like a violation of the Fair Housing Act. It would depend on the situation, and we caution everyone to head state and federal fair housing laws that protect against specific tenants from protected classes.

The point of the program is to provide rental arrearage money so that everyone stays housed where they are.

Q: A lot of the callers to Vermont Tenants hotline don’t have access to the internet and won’t be able to download even a pdf of the application. Where would we refer folks for assistance?

A: You can download the pdf on your phone using mobile data. If you are unable to do that, you can work with your landlord to get the application, call Community Action, call Vermont LegalAid, or call the Vermont State Housing Authority for the application to get mailed to you.

Q: What is the turnaround time for the application?

A: There are 10 working days for Vermont State Housing Authority to respond to the application, which may be a confirmation of a yes – in which case the payment will go directly to the landlord on the 1st and 3rd week of the month, or it may be a referral to Vermont LegalAid.

Q: Will tenants be denied if they indicate on the application that their rent is unsustainable?

A: No. That question is there only if people have the option to move to a more affordable place, and needs help to pay for rent for a more affordable apartment.

Q: If a tenant has already submitted their portion of the application and the landlord has not, how does the tenant move forward?

A: The Vermont State Housing Authority will match applications. If we are not able to get the landlord portion of the application, we will refer the tenant to Vermont LegalAid. If your landlord says they won’t submit an application, you can ask them to call the Vermont Landlord Association. Ultimately, a landlord cannot be forced to apply for the program.
